MarketINK may act in different legal capacities depending on the context:

A) Data Controller

MarketINK acts as a Data Controller when processing personal data for its own business purposes, including:

  • Client account management

  • Billing and invoicing

  • CRM management (Zoho)

  • Scheduling (Calendly)

B) Data Processor

MarketINK may act as a Data Processor when configuring automation systems or workflows on behalf of clients.

In cases where MarketINK processes lead interactions inside a client’s Instagram account, the client remains the Data Controller of such data.

MarketINK does not store or export end-customer Instagram message content.
