1. LEGAL ENTITY

This Return & Refund Policy applies to services provided by:

By purchasing any MarketINK service, you acknowledge and agree to this Policy.

2. NO PHYSICAL PRODUCTS — NO RETURNS

MarketINK provides non-tangible, customized, time-based professional services.

No physical products are sold or shipped.

Accordingly:

  • There are no returns.

  • There are no shipping-related refunds.

All deliverables are digital and service-based.

3. NO REFUNDS POLICY

All payments made to MarketINK are final and non-refundable.

This includes, without limitation:

  • Monthly subscription fees

  • One-time setup fees

  • INKY configuration fees

  • Strategy and consulting time

  • Campaign setup

  • Automation configuration

  • Optimization work

  • Advisory services

Refunds will not be issued for:

  • Partial use of services

  • Dissatisfaction

  • Performance expectations

  • Failure to achieve bookings or ROI

  • Client-side delays

  • Account suspension by third-party platforms

4. WHEN SERVICE IS CONSIDERED DELIVERED

Service delivery begins when any of the following occurs (whichever happens first):

  • Completion of onboarding or strategy call

  • Submission of onboarding form

  • Provision of account access

  • Campaign setup initiation

  • Automation configuration initiation

Once service begins, time and resources are allocated and are not recoverable.

5. MONTHLY SUBSCRIPTIONS

MarketINK services are billed monthly unless otherwise agreed in writing.

Subscriptions:

  • Renew automatically each billing cycle

  • May be canceled prior to the next billing date

  • Cancellation stops future billing only

Cancellation does not result in:

  • Refunds

  • Credits

  • Prorations

6. STRATEGIC RECOMMENDATION — THREE MONTHS

MarketINK recommends a minimum of three (3) consecutive months of service for meaningful optimization and results.

This recommendation does not create a binding minimum payment obligation.

Early cancellation does not qualify for refunds or performance-based adjustments.

7. NO PERFORMANCE-BASED REFUNDS

MarketINK does not guarantee:

  • Bookings

  • Leads

  • Revenue

  • Conversion rates

  • ROI

Marketing outcomes depend on factors beyond MarketINK’s control, including:

  • Offer strength

  • Pricing

  • Competition

  • Seasonality

  • Advertising budget

  • Response speed

  • Platform algorithms

Performance dissatisfaction does not constitute grounds for refund.

8. ADVERTISING BUDGET EXCLUSION

Advertising spend is not included in subscription fees unless explicitly stated in writing.

Clients are responsible for funding their advertising accounts.

Low or inconsistent ad spend may materially affect outcomes and does not qualify for refund.

9. INKY-SPECIFIC TERMS

INKY is an automation configuration service.

Pricing:

  • Standalone INKY: $99/month + $69 one-time setup fee

  • INKY with Foundation Plan: $99/month + $19 one-time setup fee

  • Included in Growth and Dominance plans

INKY activation requires completion of onboarding forms.

Configuration begins only after required information is submitted.

INKY is typically operational within approximately 72 hours after onboarding form completion.

Delays caused by incomplete information or lack of access are the client’s responsibility.

No refunds are issued for:

  • Delayed onboarding

  • Misuse of automation

  • Platform restrictions

10. CHARGEBACKS AND DISPUTES

If you believe there is a billing error, you must contact hello@marketinkagency.com before initiating a chargeback.

Initiating a chargeback without prior written communication may be considered a breach of contract.

MarketINK reserves the right to:

  • Suspend services during disputes

  • Provide onboarding records, timestamps, payment logs, and service documentation to payment processors

  • Recover costs associated with wrongful disputes

11. EU/UK NOTICE

If you are located in the European Union or United Kingdom, you acknowledge that MarketINK provides customized services that may begin immediately upon onboarding.

Once service performance has begun, statutory rights of withdrawal may be limited to the extent permitted by applicable law.

12. POLICY MODIFICATIONS

MarketINK may update this Policy at any time. Continued use of services constitutes acceptance of revised terms.
